An arrest for Driving While Intoxicated (DWI / DUI) does not mean you are a criminal a drunk or a bad person.  More people are falsely accused and convicted of DWI than any other crime.  The subjective opinion of a single police officer is all it takes for an innocent person to find himself handcuffed in the back of a squad car.

A single DWI arrest may give rise to three cases in three separate and distinct judicial forums.  These include: (a) the criminal charge which will be litigated in the criminal court; (b) the administrative license revocation (ALR) proceeding wherein the state will attempt to take away your driver's license; and (c) a civil proceeding initiated by you to obtain an occupational driver's license which will allow you to drive to and from work, school and in the performance of necessary household duties during the period of suspension.  Each of these is discussed in greater detail.


A person commits an offense if the person is intoxicated while operating a motor vehicle in a public place.

“Intoxicated” means:

     (a) not having the normal use of mental or physical faculties by reason of the introduction of alcohol, a controlled substance, a drug, a dangerous drug, a combination of two or more of those substances, or any other substance into the body; or

     (b) having an alcohol concentration of .08 or more.

"Alcohol Concentration" means the number of grams of alcohol per:

     (a) 210 liters of breath;

     (b) 100 milliliters of blood; or

     (c) 67 milliliters of urine.
